ARKANSAS GENERAL ASSEMBLY PASSES "THE OBESITY ACT"

The Arkansas General Assembly found time to pass House Bill 1583
before it adjourned. The bill is now commonly called "THE OBESITY
ACT". This act creates a child health advisory committee to
coordinate statewide efforts to combat childhood obesity and related
illnesses and to improve the health of the next generation of
Arkansawyers. This 15 member committee will be appointed by the Director
of the Department of Health. Although the members will meet at least
monthly and serve without salary, they will be eligible for expense
reimbursement. Office space and staff for the committee will be provided
by the Department of Health. This committee will make recommendations to
the State Board of Education and the State Board of Health consistent with
the intent and purpose of Arkansas Code Title 29, Chapter 7, Subchapter 1
(6-7-117 through 6-7-119).
"The Committee shall develop nutrition and physical activity
standards and policy recommendations with consideration of the
following:..." Basically the following consists of anything having to do
with activity and food even down to fundraisers and physical education
curriculum. [The barn door is wide open for more control from Little Rock
by unelected individuals who for the most part probably know little about
education, especially physical education, or nutrition.]
Along with the committee the bill authorizes the Department of
Education to hire 3 individuals to plan, develop, implement, and
evaluate pilot and model programs. [I thought the State was short on
funds.]
Beginning with the 2003-2004 school year all districts shall prohibit
elementary students in-school access to vending machines offering food and
beverages. [Is something wrong with a vending machine that provides fruit,
water, juice or milk?] Schools must now include in their annual report,
"the amounts and specific sources of funds received and expenditures made
from competitive food and beverage contracts."
Since teachers have nothing else to do, they will be required to
include on the report card the annual body mass index percentile by
age for the student.
[This means more time and money for developing a new report card as
well as the instruments needed for determining body mass index and
teaching the teachers how to determine body mass index. Anybody can
look at a child and tell if they are fat or skinny. Now students will get
a fat grade based on a percentile. Fat kids will probably be teased even
more. That teasing and grade will not convince the child to drop pounds,
but more than likely it will cause them to be more unhappy and eat more.
Food becomes a friend that tastes good and doesn't tease. Binge eating,
like scarfing down a dozen donuts and hoping no one sees, will more than
likely increase. Some students will probably become anorectic as they
strive for that skinny low body mass index percentile while others will
become bulimic trying to get a better percentile score by vomiting and
using laxatives. If you think these comments are far fetched, take a look
at what high school wrestlers often do to wrestle in a desired weight
class. Gorging to move up a class for the next meet is common. Stopping
eating, sweating off pounds, taking diuretics, taking laxatives and
ceasing intake of liquids to drop a weight class for a given meet are
common practices and sad to say are condoned by some coaches.]
In the school year 2004-2005, "the Department of Education shall
begin the implementation of the standards developed by the committee and
approved by the Department of Education; and annually monitor and evaluate
the implementation and effectiveness of the nutrition and physical
education standards. Every school district shall, "Convene a school
nutrition and physical activity advisory committee that shall include
members from the school district governing boards, school administrators,
food service personnel, teacher organizations, parents, students, and
professional groups such as nurses and community members to help raise
awareness of the importance of nutrition and physical activity; and assist
in the development of local policies that address issues and goals,
including, but not limited to the following:..." Basically the following
consists of raising awareness of the importance of nutrition and physical
activity, developing local policies, assisting with implementation of
standards, integrating nutrition and physical activity into the overall
curriculum, ensuring in-service training in these areas, improving the
quality of physical education curricula, increasing the training of
physical education teachers, enforcing existing physical education
requirements and pursuing contracts that encourage healthy eating and
reduce school dependence on profits from the sale of foods of minimal
nutritional value.
Also in the school year 2004-2005 every school district will begin
the implementation of standards developed by the committee and
approved, require that goals and objectives for nutrition and
physical activity be incorporated into the annual school planning and
reporting process. The Department of Education and the Department of
Health shall report annually on standards implementation to the co- chairs
of the House and Senate Interim Committees on Public Health, Welfare, and
Labor.
[All these years, as a teacher, I must have been under the misguided
assumption that the purpose of the public school was for children to learn
to read and write, figure math, learn history and learn about government
and geography. A lot of tax dollars must have been wasted on my salary. To
me it seems that turning off the television and sending children outside
to play would be more cost effective and beneficial to health. Mothers
preparing a good breakfast for their children of a morning and kissing
them as they walk out the door to walk to school with their fruit snack,
thermos bottle and lunch bag in hand just might also be more cost
effective and beneficial to health. Does the school really need to serve
as the fat police and a food service provider at tax payer's expense?]

and prosecutor. Yes, you can get the head of the bar to perjure himself
in order to get the conviction--if you are the prosecutor and judge. Yes,
it is true that you can be prosecuted for and convicted of thought crimes.

I am Philip Mann, and I'm sure alot of you know of my battle for justice

9th - in the way of making a phonecall. Judge Paul Czajka is the judge in
my Surrogate Court case against the trustees of my father's estate. He
made up his mind he was going to bury me one afternoon when I refused his
demand that I settle with the trustees without a proper accounting of the
trust. He told my lawyer, Thomas Benton, "Tell Phil I'll remember that
when it comes time for trial." That s.o.b. gave away the money my father
saved a lfetime, literally, to leave to his children, and he gave it to
the trustee accused of stealing from the trust and perjuring herself. I
don't think you can get anymore crooked than that. He taught me a lesson
alright; a crooked judge can get away with almost anything! Now is the
time to hold this judge accountable for his misdeeds. I'm asking
everybody, and everybody you can get, to call the judge above Judge Czajka
and express your disgust with the way this "judge" is running his court.
I took out a fraud lawsuit, in Supreme Court, against the allegedly
crooked lawyers who concocted the scheme which disinherited my family, and
by the grace of God it was scheduled with another judge, Judge Christian
Hummel. Judge Czajka managed to get Judge Hummel off the case so Judge
Czajka could have it - and now it's assigned to Judge Czajka. He's got the
case in Surrogate's Court, and he reached over and took the case in
Supreme Court which was already assigned to another Judge. THIS IS JUST
PLAIN CROOKED!
The judge above Judge Czajka is Judge Trafficanti. I will ask everyone and
their mother to please call Judge Trafficanti on Weds. July 9, AND
POLITELY PROTEST THE ACTIONS OF JUDGE PAUL CZAJKA. PLEASE.
Judge Czajka should never have been allowed to switch the other judge off
the Supreme court case and put himself on it. Never!
Please call Judge Trafficanti and ask for the original judge, Judge
Christian Hummel, to be put back on the case.

I've been busy writing briefs, etc. and will now give you an update as to
what is happening with my case. At this moment, I am waiting for the Maine
Supreme Court's decision of their stay of the writ of possession against
me. First, a little background.
June 4, 2003: My appeal of York County Superior Court Judge Paul
Fritzsche's
order (June 3, 2003) was docketed in the Maine Supreme Court. I appealed
his denial of my jury trial demand, pending litigation against the City of
Biddeford which was filed before the forcible entry & detainer against me
and his issuance of a writ of possession against me.
July 9, 2003: My brief due in the Maine Supreme Court.
June 5, 2003: I filed an Injuction in the Maine Supreme Court against the
issuance of the writ of possession.- no action taken.
June 19, 2003: I was served with a writ of possession
June 20, 2003: I filed a motion for emergency hearing for injunction
against the writ of possession
June 20, 2003: A protest was held in front of Biddeford City Hall; we
awaited the decision of the Maine Supreme Court on my Emergency
Injunction. Late
afternoon, I received word that a "stay" of the injunction was granted.
Maine Supreme Court Justice, Don Levy, stayed the writ of possession with
an order that I file a brief on or before June 27, 2003 which I did.
(attached) Tim Q. Ly's attorney was to file his brief on or before July 7,
2003 and I may file a reply brief on or before 11:00 a,m, on July 9th,
2003.
June 30, 2003 (Monday) : I received a letter from the Maine Supreme
Court
Clerk, James Chute, stating that I must send 8 additional copies of my
brief to the court.
July 3, 2003: I submitted my additional 8 copies to the Maine Supreme
Court, in hand. My discussion with Marsha, a clerk in the court's office,
was total confusion on the part of the clerk's office. Marsha did not have
my file at hand and was totally confused as to the prodecure in this case.
She asked that I call the office later in the day when James Chute, Clerk,
would be in the office. As we spoke, Mr. Chute entered the office. I
stated that if this office was
confused about the procedure in this case, how could I follow the rules
and comply when this office was confused. I asked about my appeal,
docketed on June 4, 2003 and the court's requesting of 8 additional copies
of my brief in
response to Justice Levy's order, dated June 20th. I was told by James
Chute, clerk, that Judge Levy's order supercedes my appeal. The brief I
submitted, pursuant to Levy's order, has been added to an excellerated
list and IS my appeal. I questioned the rules of appellant procedure vs.
injunction, and was told that they do not have rules for every issue
presented. This court is considering my injunction as an appeal, but not
following appellant rules of procedure. I was told that Atty. Jens-Peter
Bergen has filed for an extention of time because he had previous vacation
plans and his son was home from college and needed more time. I filed, and
orally objected to the extension of time (attached), and mailed it out
today.
As you will see, Atty. Bergen received notice on June 20th of Justice
Levy's order; that I sent Atty. Bergen my brief on June 27th, which he
should have received on June 28th and has had ample time to reply or
request an extension of time. He has had 10 days to reply and wants an
extension. I am ordered to reply to his brief within 24 hours or less. I
will reply! As an attorney, he is more qualified than I am and should NOT
be given an extension of time.
During my conversation with James Chute, Clerk of the Courts, I
mentioned that
York County attorneys have a habit of filing "whatever" on the weekend,
Fridays, or a holiday, such as this weekend. The courts are not open and I
am at a disadvantage. I mentioned that mail sent to me from the
neighboring town, which I should receive the next day, I don't receive
until 4 days later. I questioned Atty. Bergen's reply brief and what
happens if I do not receive his brief before July 9th. Mr. Chute said
"we'll cross that bridge when we get to it." I replied "I know there's a
bridge ahead and I want to have my canoe and paddle in order to "cross
that bridge." He replied again, "we'll cross that bridge when we get to
it."
As it stands right now, my appeal is consolidated into this Emergency
Injunction" that I have filed. The Maine Supreme Court must consider my
original complaint against the City of Biddeford. Whether they will or
not, I don't know. I do know that I WILL DEFEND MY PROPERTY!
We are planning another rally in front of the Maine Supreme Court on
Tuesday
and/or Wednesday, July 7th &/or 8th. If you, and your friends, can be
